Quality - price - time ratio

The tender with the award criterion of the most economically advantageous offer takes more time because it is necessary to establish a commission to evaluate the offers, but it is the only way to enhance public assets. Contractors must work hard to prepare the technical offer with the details of an executive project that optimizes the quality-price ratio.

In most specialist works, the experience of the contractor's technicians and operators is decisive to guarantee the quality of the work, to respect the work program and to reduce the risk of disputes. The accurate estimate of labor costs improves the socio-economic conditions of operators, promoting qualified and responsible employment towards communities and the environment.

It is best to carefully select the criteria that favor products, methods and workers that guarantee quality, organization and safety during execution to achieve the objectives of the work. The designer's skills and experience allow him to identify objective criteria and sub-criteria, giving the right weight to each of them.

The criteria can be more effective than the design itself, because in some way the contractor is asked to improve and correct any design deficiencies. However, we must be careful, because the additional works or services must be relevant to the project and, in our opinion, the overall cost of the offer must still be reasonable to avoid market distortions and infiltration by organized crime.

Tender procedures

Depending on the designer's experience, different paths can be taken:

  1. when the object is well known, it is advisable to develop an executive project that establishes the minimum characteristics of the products, systems and methods that guarantee satisfaction of the requirements, with the possible possibility of presenting an improving project proposal which, if it deviates from the original project, obliges the bidder to rectify the executive project;
  2. when the degree of technology or innovation is prevalent you need to have high profile technical skills; therefore, it is better to develop a definitive project and ask competitors to propose an executive design offer that meets the requirements to be met, pursuant to article 59 paragraph 1-bis of Legislative Decree 50/2016 and subsequent amendments;
  3. when the period of use and maintenance can have a great impact on the effectiveness of the work, but monitoring and reporting are also necessary, as is typical of green projects linked to tenders promoted by the European Commission, it is best to pursue mixed procurement, pursuant to art. 28 of Legislative Decree 50/2016 and subsequent amendments;
  4. when the degree of technology or innovation and the period of use and maintenance, as well as monitoring and reporting, are closely related to achieving the objectives of the project, it is best to launch a tender on the basis of the combined provisions of both of the above articles provided for by the Code.

All routes transfer responsibility for the development of the detailed technical offer to the bidder, limiting the risk of appeals or reservations in relation to alleged design errors.
